Prof. Pat Utomi has urged the Federal High Court in Abuja to dismiss a suit filed by the Department of State Services (DSS) accusing him of planning to establish a "shadow government" in Nigeria.
The case, set for hearing on Wednesday, has drawn significant attention due to its implications for political engagement and freedom of expression.
Prof. Utomi, a respected Professor of Political Economy and former presidential candidate, filed a preliminary objection through his lawyer, Chief Mike Ozekhome, SAN, challenging the court's jurisdiction over the case. He argued that the DSS's action lacks a reasonable cause and does not align with the statutory functions outlined in the National Security Agencies Act.

Utomi contended that the suit seeks to criminalize constitutionally protected rights to freedom of expression and political participation. He described the DSS's allegations as speculative and without a factual basis, asserting that they do not fall within the agency's powers.
In his affidavit, Utomi detailed his extensive background in academia, entrepreneurship, and public service, emphasizing that his activities have always been within legal and civic frameworks. He labeled the DSS's suit as an abuse of judicial process, aimed at stifling legitimate political discourse.
